"After careful consideration, including a review of my recommendation, the President has concluded that given a number of factors, including a documented history of discrimination, classifications based on sexual orientation should be subject to a more heightened standard of scrutiny. The President has also concluded that Section 3 of DOMA, as applied to legally married same-sex couples, fails to meet that standard and is therefore unconstitutional. Given that conclusion, the President has instructed the Department not to defend the statute in such cases. I fully concur with the President’s determination."
Barry O finally got some balls, it appears-- he just up and decided he's the mothafuckin' president and he doesn't HAVE to discriminate if he doesn't want to, thank you very much. Sweet.
I didn't really understand all the legalese, so if any of you lawyerly types can give me a more in depth analysis, feel free to drop me a line and let me know. Regardless, the Department's refusal to defend the constitutionality of Section 3 (defining marriage as opposite sex only) is HUGE and is another nail in bigotry's coffin. President Obama is asking the Department Of Justice not to defend the Defense Of Marriage Act in court. The DOJ is agreeing with President Obama.
ReplyDeleteUnfortunately, DOMA remains the law of the land and will remain so until Congress repeals DOMA or The Supreme Court declares DOMA unconstitutional.
There's another memo by the DOJ to House Majority Boehner telling him it's on his ass.
